These Terms of Service ("Terms") govern your use of the Control: Kegel Coach Men mobile application (the "App"), operated by Surreel Studio. By using the App you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
The App is intended for users aged 18 and over. By using the App you confirm you meet this requirement.
2. Educational and Fitness Purpose; No Medical Advice
Control: Kegel Coach Men is a fitness and wellness application focused on pelvic floor training. The App is for educational and fitness purposes only. It is not a medical device, does not diagnose, treat, cure or prevent any disease or condition, and is not a substitute for consultation with a qualified healthcare professional. Individual results vary; no specific outcome is guaranteed. If you are pregnant, recovering from surgery, have a history of incontinence, pelvic pain, prostate conditions, hernia, or any other condition that may be affected by pelvic floor exercise, consult a qualified healthcare provider before starting any program. Stop exercising and seek medical advice if you experience pain, bleeding, or symptoms that worsen.
3. Account
You are responsible for safeguarding any credentials you use to access your account. Notify us promptly if you suspect unauthorized access. You may use the App anonymously or upgrade to a signed-in account (email, Apple, or Google). When you upgrade an anonymous session, your prior progress is merged into the new account.
4. Subscriptions
4.1 What is offered
Premium features are offered through auto-renewable subscriptions, available as weekly, monthly, yearly, and (where offered) lifetime purchase, processed by Apple via In-App Purchase.
4.2 Free trial
A free trial may be offered to new subscribers (typically a 7-day trial associated with the monthly or yearly subscription). If you do not cancel the subscription at least 24 hours before the trial ends, your selected subscription will automatically begin at the listed price. Free-trial eligibility is determined by Apple on a per–subscription-group basis; an account that has previously used a free trial in the same subscription group is not eligible for another trial.
4.3 Auto-renewal
Subscriptions automatically renew at the end of each billing period at the then-current listed price, unless cancelled at least 24 hours before the end of the current period. The renewal amount is charged to your Apple account within 24 hours before the period ends.
4.4 Cancellation and management
You can cancel a subscription, change plans, or view renewal details at any time by going to Settings → Apple ID → Subscriptions on your iOS device. Cancellation takes effect at the end of the current billing period; you keep access until then.
4.5 Restore purchases
If you reinstall the App or sign in on a new device, you can restore an active subscription using the Restore Purchases action available on the paywall and in the profile settings. Restore requires being signed in to the same Apple ID used to purchase.
4.6 Refunds
Refunds, where applicable, are handled by Apple in accordance with Apple's policies. We do not process refunds directly.
4.7 Price changes
We may change subscription prices. Material price changes affecting existing subscribers are subject to Apple's price-change consent process; you will be asked to confirm the new price before it takes effect.
5. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the App.
- Use the App in a way that violates applicable law.
- Resell, sublicense, or redistribute the App without our written consent.
- Interfere with the App's security mechanisms or accessing controls.
- Use the App in nuclear, aviation, life-support, or other hazardous environments where failure could cause death, personal injury, or environmental damage.
6. Intellectual Property
The App, including content, design, written copy, illustrations, and trademarks, is owned by Surreel Studio or its licensors. You receive a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control, as permitted by Apple's App Store Terms.
7. User Content
If you submit feedback, suggestions, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use that content to improve and operate the App.
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components.
9. Limitation of Liability
To the maximum extent permitted by law, Surreel Studio is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of or inability to use the App. Total aggregate liability for direct damages will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 50.
10. Termination
We may suspend or terminate access to the App if you breach these Terms. You may stop using the App and delete your account at any time from the profile screen.
11. Apple End User License Provisions
This section applies because the App is distributed via the Apple App Store. You and we acknowledge:
- These Terms are between you and Surreel Studio, not with Apple. Apple is not responsible for the App or its content.
- Your license to use the App is a non-transferable license to use the App on Apple-branded products you own or control, as permitted by the App Store Terms of Service.
- Maintenance and support for the App is solely the responsibility of Surreel Studio. Apple has no obligation to furnish maintenance or support.
- Apple has no warranty obligation with respect to the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation.
- Surreel Studio, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar legislation.
- Surreel Studio, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual-property infringement claim relating to the App.
- You represent that (i) you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any U.S. government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, will have the right to enforce these Terms against you.
12. Changes
We may update these Terms. We will reflect material changes by updating the version and publication date shown above. Continued use of the App after a material change constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the Republic of Turkey. Disputes will be handled by the courts of Istanbul, Turkey, unless mandatory local consumer-protection law provides otherwise. EU and UK consumers retain the protections of their local mandatory law.
